Stallion Contract
This STALLION BREEDING CONTRACT is for the 200_
breeding season, is made and entered into on this ______________ day
of _______________, 200_ between Tiani Heider, hereinafter designated
Breeder, and ___________________________________, hereinafter designated
Mare Owner. Mare Owner agrees to breed the mare _______________________________,
Reg. No._________________________ to the stallion Sully Diamonddust,
ApHC Reg. # 502086 for the fee of $________________, for a live foal,
subject to the following conditions:
- The stallion fee includes a non-refundable booking fee of $200.00,
payable with this contract, the balance of which must be paid with all
other expenses when the mare is picked up, unless other arrangements
have been made in advance.
- The Mare Owner shall agree that each mare offered for
breeding shall be in sound breeding condition and free from infection
or disease.
- Mare Owner will submit the completed Reproductive History
Questionnaire and a copy of the mare's registration papers (both sides)
with a signed copy of this contract. Mare Owner shall also supply a
copy of the mare's current negative Coggins report, worming and
immunization record.
- The Breeder agrees to diligently try to settle the above
named mare, and shall have sole discretion of determining the best
method of breeding such mare. If, however, the mare does not settle,
the Breeder shall be held harmless. Mare Owner agrees to give Breeder
ample opportunity to settle mare and not remove the mare before the end
of her estrus cycle. There will be no guarantee of a live foal for any
mare not being checked as "safe in foal" by a licensed veterinarian.
- Live Foal Guarantee. Live foal means the foal shall stand
and nurse. It is understood if the mare proves barren, aborts her foal,
or if the foal is stillborn, a return season will be guaranteed for the
200_ breeding season only, providing notification is given. Proper
notification shall be defined as follows: Written certification from a
licensed veterinarian within seven days that the mare has slipped or
produced a non-viable foal. Mare Owner certifies that such abortion or
death did not result from any act or omission of the Mare Owner's
subsequent to the mare being determined "safe in foal" by a licensed
veterinarian. Booster rhinopneumonitis vaccinations must be
administered as indicated by the drug manufacturer as the mare
progresses through her pregnancy. Failure to do this will void live
foal guarantee.
- The breeding season in force for this contract shall begin February 15, 20__, and close August 31st, 20__.
- A "Breeder's Certificate" will be issued for the foal,
conceived by this mating, when stallion fee and all other expenses have
been paid in full.
- Both parties agree that the Breeder, their agents or
employees are not liable for death, sickness and/or accident including
consequential damages caused to the mare and/or foal, unless such
death, sickness and/or accident was by the willful and wanton
negligence of the Breeder: and Mare Owner is not liable for the death,
sickness, and/or accident including consequential damages to the
stallion.
- It is further agreed that should the stallion die, be sold
by the owner, or become unfit for service prior to settling the mare,
that the service fee will be refunded less the booking fee, thereby
canceling this entire contract; or, if mare dies or becomes unfit to
breed before being pronounced safe in foal, the Breeder has the option
to either (a) accept another mare as replacement or (b) refund whatever
fee has been paid, less booking fee and all other expenses; thereby
canceling this contract.
- This contract is non-assignable, and non-transferable
- This contract represents the entire agreement between the
parties. No other agreements, promises, verbal or implied, are included
unless specifically stated in this written contract.
- Each party should individually initial any additional
conditions listed as follows:

Breeding Checklist
This checklist is intended to serve as a summary of Mare Owner's responsibilities.
- The stud fee for Sully Diamonddust is _____________. The non
refundable booking fee of $200.00 is due with the signed breeding
contract. Mare Owners should book early.
- A copy of the mare's registration papers (both sides) must
also be included with the signed contract along with the completed
reproductive questionnaire.
- A copy of the mare's health records must be provided.
- A copy of the mare's current (within 6 months) negative Coggins must be supplied.
- The mare must be halter broke.
- The mare must be barefoot on both hind feet.
- Balance of the stud fee $____________, is due when the mare
is picked up. All expenses incurred on behalf of the mare must be paid
in full prior to removing the mare from the premises.
- Live foal guarantee. If the mare does not produce a live
foal in 20__, a rebreed will be allowed for the same mare, or approved
substitute mare for the 20__ season only. Live foal guarantee is
subject to the terms of the breeding contract and the live foal
guarantee checklist.
- If the mare owner is unfamiliar with mare's reproductive
history, mare owner may substitute a complete breeding examination
report from a licensed veterinarian. This report will include a uterine
culture.
- The daily mare care boarding fee charged by the Breeder is
your responsibility. Arrangements should be made well in advance of the
mare's anticipated estrus cycle.
- It is the mare owner's responsibility to provide needed or
recommended veterinary and/or farrier services. If the mare owner is
unable to be present during examinations or procedures, Breeder will
arrange such treatment at mare owner's expense.
- Mare Owners who choose to bring the mare to the stallion
during estrus and leave immediately after breeding, are subject to a
facilities use charge. The entire stud fee is due in full at the time
of the first attempted breeding, regardless of outcome.

Live Foal Guarantee Checklist
In order for the Live Foal Guarantee to be valid, the following checklist is provided as a guide
- Mare must be checked by a licensed veterinarian (ultrasound, palpation) and pronounced "safe in foal" within 45 days.
- A copy of the veterinarian's report must be supplied
to the breeder, which states that the mare is "safe in foal". Failure
to provide a copy of this report to the Breeder voids your Live Foal
Guarantee.
- Mare Owner is required to provide booster
rhinopneumonitis vaccinations throughout the course of the pregnancy as
the drug manufacturer indicates. Failure to provide such vaccinations
voids your live foal guarantee.
- Mare Owner is required to provide sufficient
nutritious and wholesome feed as the mare needs to maintain good
physical health. This should include a supplemental product during the
last trimester designed to meet your mare's increasing nutritional
demands.
- It is strongly suggested that the Mare Owner provide
adequate and safe foaling accommodations. Failure to provide safe and
sanitary conditions for foaling will void your live foal guarantee
(i.e., mare foals on snow, mud, etc.)
- Mare Owner is required to have a licensed veterinarian examine the foal within 24 hours of birth.
